1. Who we are

Happen AI is operated by Abhishek Paul, based in India. Contact: privacy@happen-ai.com.

2. Data we collect

Account data: email, name (optional), hashed password. Usage data: API request counts, token counts, timestamps — for billing and service improvement. Pack metadata: pack IDs and versions you install, so we can show you updates.

3. Data we do NOT collect

We do not read or log the contents of your conversations with agents when they run locally on your desktop. We do not train models on your data. We do not sell data. We do not share data with third-party advertisers.

4. Third-party services

If you use our optional cloud runtime (Pro/Business), conversations are proxied through the provider you chose (Anthropic, OpenAI, or others). We do not store message content by default; we store usage counters and error logs with message content redacted. Billing is processed by LemonSqueezy (Merchant of Record), subject to their privacy policy.

5. Your rights

You can export, delete, or correct your data at any time by emailing privacy@happen-ai.com. EU residents: GDPR rights apply. California residents: CCPA rights apply. Indian residents: DPDP Act 2023 rights apply.

6. Data retention

Account data retained until account deletion. Usage logs retained 13 months for billing dispute resolution. Backups retained 35 days.

7. Security

API keys stored encrypted at rest (Fernet with per-deployment key rotation). All traffic over HTTPS (TLS 1.2+). No security is perfect; breach notifications within 72 hours per GDPR Article 33.

1. Agreement

By using Happen AI, you agree to these terms. If you don't agree, don't use the service.

2. Who can use it

You must be 13 or older (16+ in EU). You must have authority to accept these terms on behalf of your organization if you sign up on its behalf.

3. Your account

Keep your password secure. You are responsible for activity under your account. One person per account; don't share.

4. Packs and licensing

Packs (.hpk files) are sold under per-tier licenses:

• Personal ($149): individual, non-commercial use, 3 installs.
• Commercial ($349): single entity, commercial use, 10 installs.
• Agency ($799): use across client projects, 25 installs.
• Source ($1,499): source code access, meaningful transformation required for redistribution.

Pack sellers retain copyright; we facilitate the transaction.

5. Subscriptions

Pro ($5/mo) and Business ($29/mo) subscriptions renew automatically until cancelled. Cancel anytime. Quotas reset monthly; overage = soft-fail (service may degrade, never silent overcharge).

6. Acceptable use

Don't: use it for illegal purposes, CSAM, harassment, spam, running malware, bypassing rate limits, reverse-engineering our binaries beyond fair use, reselling the desktop app, or publishing packs you don't own rights to.

7. Intellectual property

We own Happen AI, the desktop app, the hub, and trademarks "Happen AI" and "Happen Pack". The .hpk format specification is open under MIT license.

8. Warranty & liability

Service provided "as is". We disclaim all warranties to the maximum extent permitted by law. Our liability is capped at fees you paid us in the 12 months preceding the claim. Nothing in these terms limits liability for death, personal injury, fraud, or anything else that cannot be limited under applicable law. EU and UK consumer rights apply regardless.

9. Termination

You can cancel anytime. We can suspend or terminate accounts that violate these terms. Data export available for 30 days post-termination.

10. Changes

We may update these terms. Material changes: 30 days advance email notice. Continued use = acceptance.

11. Governing law

These terms are governed by the laws of India. Disputes resolved in the courts of Bengaluru, Karnataka. Mandatory consumer protection law in your jurisdiction still applies.

Packs (one-time purchases)

14-day refund on any pack, no questions asked, provided you have not yet activated more than 1 install of the pack. Activating multiple installs indicates use; after that, refunds are case-by-case for defects.

Subscriptions (Pro / Business)

Cancel anytime from your account. You retain access until the end of the current paid period. No partial-month refunds by default — but if you cancel within 3 days of renewal and haven't used the service that period, email us for a courtesy refund.

How to request

Email refunds@happen-ai.com with your order ID (from LemonSqueezy receipt). Refunds processed within 5 business days to your original payment method.

Chargebacks

Please email us before filing a chargeback — we'll almost always resolve faster than the card network. Chargebacks without prior contact may result in account suspension.

Statutory rights

EU/UK consumers: you have a 14-day cooling-off right for digital content that has not yet been downloaded. India: Consumer Protection Act 2019 rights apply.
